Terms of Service – Simply Delicious Food

1. Acceptance of Terms

By downloading, installing, or using the Simply Delicious Food mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Simply Delicious Food is a mobile application that provides users with:

  • Access to a curated collection of recipes
  • Meal planning and organization tools
  • Shopping list generation and management
  • Recipe saving and bookmarking features
  • Unit conversion tools for cooking

3. User Accounts

3.1 Account Creation

  • You must create an account to access certain features of the App
  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must verify your email address to access all features

3.2 Account Security

  • You are responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • We are not liable for losses resulting from unauthorized account access

4. Subscription Services

4.1 Simply Delicious+ Premium Subscription

The App offers a premium subscription service (“Simply Delicious+”) with the following benefits:

  • Ad-free experience
  • Unlimited recipe saves
  • Meal plan saving and loading
  • Smart shopping list generation
  • Organized shopping categories
  • Early access to new features

4.2 Subscription Terms

  • Monthly Subscription: $9.99 per month
  • Annual Subscription: $99.99 per year
  • Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage or cancel subscriptions through your Apple ID Account Settings

4.3 Free Trial

  • New users may be eligible for a free trial period
  • You must cancel before the trial period ends to avoid charges
  • Free trial eligibility is determined by Apple and may not be available to all users

4.4 Cancellation

  • You may cancel your subscription at any time through your Apple ID Account Settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods
  • You will continue to have access to premium features until the end of your current billing period

5. Free Version Limitations

The free version of the App includes the following limitations:

  • Maximum of 10 saved recipes
  • No meal plan saving functionality
  • No shopping list generation
  • Advertising content display

6. User Content and Conduct

6.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App’s functionality
  • Share your account credentials with others
  • Use the App to transmit harmful, offensive, or inappropriate content

6.2 User-Generated Content

  • Any custom items or content you create in the App remains your property
  • You grant us a limited license to use, store, and display your content as necessary to provide the service
  • You are responsible for the accuracy and legality of any content you create

7. Intellectual Property

7.1 App Content

  • The App, including its recipes, text, graphics, and functionality, is owned by The Ryder Creativ
  • Recipe content is used under appropriate licenses and permissions
  • You may not reproduce, distribute, or create derivative works from the App content

7.2 Trademarks

“Simply Delicious Food” and related marks are trademarks of The Ryder Creativ.

8. Third-Party Services

The App integrates with third-party services including:

  • Firebase (Google) for authentication and data storage
  • Google AdMob for advertising
  • Apple StoreKit for subscriptions

Your use of these services is subject to their respective terms and privacy policies.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our Privacy Policy.

10. Disclaimers and Limitations

10.1 Service Availability

  • We strive to maintain App availability but cannot guarantee uninterrupted service
  • We may temporarily suspend the service for maintenance or updates
  • We are not liable for service interruptions

10.2 Recipe Information

  • Recipes are provided for informational purposes only
  • We do not guarantee the accuracy, completeness, or safety of recipe information
  • Users are responsible for food safety and dietary considerations
  • Always verify ingredient safety and allergen information

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RYDER CREATIV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless The Ryder Creativ from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or deleting the App.

12.2 Termination by Us

We may terminate or suspend your account if you violate these Terms or for any other reason at our discretion.

12.3 Effect of Termination

Upon termination, your right to use the App ceases immediately, but these Terms remain in effect regarding past use.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Apple App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that:

  • These Terms are between you and The Ryder Creativ, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide support for the App
  • Apple is a third-party beneficiary of these Terms regarding your use of the App

15. Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.

Important Notice for Subscription Services:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period
  • Account will be charged for renewal within 24-hours prior to the end of the current period
  • Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user’s Account Settings after purchase
  • Any unused portion of a free trial period will be forfeited when the user purchases a subscription to that publication
